Terms of Service

These Terms govern your use of Datify. By creating an account or using the API, you agree to them. Last updated 2026-05-06.

1. Who we are

"Datify", "we", "us" refers to Handitech Lime Solutions Ltd, Reg. No. BN308300325, Ablekuma, Accra, a company organized under the laws of Ghana.

2. Your account

You must provide accurate registration information and keep your login credentials confidential. You're responsible for activity under your account, including purchases made by anyone using your wallet or API keys.

We may suspend or terminate accounts that violate these Terms, applicable laws, or our acceptable-use guidelines (including fraud, chargebacks, abuse of carrier networks, or harassment of staff).

3. Wallet, payments, and refunds

  • Wallet funds are held with our payments partner (Paystack) and may only be used to purchase bundles through Datify.
  • Successful bundle deliveries are non-refundable — once the carrier confirms delivery to a SIM, we cannot reverse the transaction.
  • Failed deliveries are automatically refunded to your wallet. If a delivery is stuck in processing for longer than a reasonable window (typically 1 hour), contact support with the transaction reference.
  • We do not offer cash-out of wallet balances except where required by law. Wallet funds are not interest-bearing.

4. Pricing

Retail prices for end users include the cost we pay upstream plus a margin. Reseller pricing reflects wholesale rates set by our upstream provider; per-account custom pricing may apply where agreed in writing. Prices may change with reasonable notice.

5. Reseller API

If you have an API key, you agree to:

  • Keep keys confidential, rotate them on compromise, and revoke unused keys.
  • Respect documented rate limits.
  • Provide your end users with reasonable terms and a way to reach you for refund or delivery issues.
  • Not resell access to the API itself, sublicense it, or use it to attempt to circumvent network or carrier policies.

6. Acceptable use

You agree not to use Datify to:

  • Conduct fraud, money-laundering, or any activity prohibited by Ghanaian law.
  • Send bundles to numbers obtained without consent.
  • Attempt to disrupt the service, probe for vulnerabilities without authorization, or reverse-engineer non-public components.
  • Misrepresent yourself to support staff.

7. Service availability

We aim to keep the service available but do not promise uninterrupted operation. Carrier outages, scheduled maintenance, and force-majeure events may affect delivery. We'll communicate planned downtime where reasonable.

8. Liability

To the maximum extent permitted by law, Datify is liable only for direct losses up to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect or consequential losses (lost profits, lost opportunity, downstream business impact).

9. Governing law

These Terms are governed by the laws of Ghana. Disputes will be resolved in the courts of Ghana sitting in Accra, except where mandatory consumer-law rules require otherwise.

10. Changes

We may update these Terms when the product or law changes. Material changes will be communicated by email or in-product notice at least 30 days before they take effect.
